Court documents lay out February altercation involving Malta suspect

Brandon Moore, the Malta man fatally shot by police following a standoff at his apartment complex on Thursday, had recent prior contact with State Police.

Witnesses to the event mentioned seeing Moore in a "commotion" at the Ellsworth Commons dog park in February, in which he and his girlfriend allegedly assaulted another couple also using the dog park.

CBS6 has obtained court documents charging Moore with assault in the 3rd degree, a class A misdemeanor, on Feb. 1. The affidavit, dated Feb. 5, indicates that Moore struck the victim "repeatedly" with a closed fist, breaking the victim's nose and orbital bone. It also indicates that Moore's girlfriend was present and involved, allegedly assaulting the victim's girlfriend before the men became involved, yelling, "Just wait until my boyfriend gets here." According to the affidavit, Moore struck the victim's girlfriend, knocking her to the ground, before the pair walked away.

The victim's statement refers to a witness who saw part of the altercation; that witness, an Ellsworth resident named Andrew, separately described the incident to CBS6 on Thursday.
