SO, WHEN YOU GET TESTED FOR MARIJUANA, IT MAY SHOW IN YOUR SYSTEM, BUT THAT DOES NOT MEAN YOU ARE CURRENTLY UNDER THE INFLUENCE, NECESSARILY. MANY FIRMS ALREADY HAVE RESTRICTIONS ON WORKERS WHO MAY BE ON PRESCRIPTIONS, FROM OPERATING CERTAIN KINDS OF MACHINERY. OR PERFORMING CERTAIN KINDS OF WORK. SOME HUMAN RELATIONS DIRECTORS SAY THEY EXPECT THE MEDICAL MARIJUANA POLICIES TO BE SIMILAR TO THE GUIDELINES FOR WORKERS WHO MAY HAVE A CHRONIC MEDICAL CONDITION. AT THIS POINT, THERE IS NOT MUCH CASE LAW ON THE ISSUE. THE MAIN GUIDELINE WILL PROBABLY BE THE CORPORATE POSITION ON MEDICAL MARIJUANA. NOW THEY’VE GOT SOME TIME TO WORK THIS OUT. But unlike alcohol, it stays in a person's system for 30 days and could show up on a workplace drug test.“So if you are an employee and you test positive for marijuana, and it's from 25 days ago, and you're not currently under the influence, that's what employers need to think about with respect to the workplace policy,” said attorney Tedrick Housh, of Lathrop Gage.Many firms already have restrictions on workers who may be on prescriptions from operating certain kinds of machinery or performing certain kinds of work.Some human relations directors say they expect the medical marijuana policies to be similar to the guidelines for workers who may have a chronic medical condition.
